Chapter 8.76 INSECT CONTROL

8.76.010 Insect control measures.

A. For purposes of this chapter, insects shall be defined as all stinging or biting insects and venomous arachnids including, but not limited to, fleas, flies, roaches, Africanized bees, honey bees, wasps, hornets, yellow jackets, mosquitoes, black widow spiders, brown recluse spiders and scorpions. All premises shall be cleaned, and effective insecticides applied, as often as necessary to prevent the harboring of insects that may be a danger to the public.

B. It is unlawful for any person to maintain or permit a beehive, nest or swarm to exist that may pose a danger to the public health, safety and welfare.

1. The prohibition regarding maintenance of beehives, nests or swarms shall not restrict the activities of a professional beekeeper if permitted under the city's zoning code. For purposes of this subsection, the term "professional beekeeper" shall mean a person who holds a current registration as a beekeeper with the county of Los Angeles department of agricultural commissioner.

2. The prohibitions of this section shall not apply to the keeping of bees within an educational institution for study or observation or within a physician's office or laboratory for medical research, treatment or other scientific purposes, provided the bees are not permitted to fly at large. 8.76.020 Insect control violations-Misdemeanor.

A. Whenever in this chapter, any act is prohibited or declared unlawful or the doing of any act is required, or the failure to do any act is declared to be unlawful, it shall be a misdemeanor for each incident and/or each day of failure to comply.

B. Any violation of this chapter is hereby declared to be a public nuisance and an immediate threat to the public health, safety and welfare, subject to abatement. (Ord. 5492 § 3 (part), 2005)
